Today, the Senate passed an amended version of the Military Commissions Act 2006,¹ S. 3930.

I have blogged that it is unwise to use the military commissions enacted today. In that blogging I urged America to provide every detainee or "designated enemy combatant" with exactly the same "equal justice under the law" enjoyed by us all.²

Bush is wrong when he said today:

"our most important responsibility is to protect the American people from further attack"

Bush and those voting in Congress to enact S. 3930³ have failed in our most important responsibility, protecting and upholding the United States Constitution.

Bush has also failed at protecting Americans from further attack. As the recently leaked and then partially declassified National Intelligence Estimate (NIE April 2006) ⁴ makes clear, we are at greater risk of another terrorist attack.

1. Senator Levin, during senate debate has provided a useful summary of the differences between the Military Commissions Acts. The one passed by the Senate Armed Services Committee and the Military Commissions Act 2006 which the Senate by a vote of 65 to 34 (Snowe not voting - Senate link to vote on S. 3930 as amended) passed today.

2. I agree that providing "equal justice under the law" to each detainee or designated enemy combatants would interfere with or truncate the current CIA interrogation and torture techniques used on detainees and designated enemy combatants.

3. The House passed H.R. 6160 yesterday.

4. The entire NEI (April 2006) should be made public.
