Our government, in its ever expanding efforts to "protect" Americans from perceived endogenous and exogenous threats will add the Automated Targeting System (ATS) threat module to the Treasury Enforcement Communications System (TECS) in December 2006.1
ATS collects commercial, cargo and personal data2 directly and via links to other databases. The data so collected will be retained for up to forty years. These data will be shared with virtually every governmental and non-governmental entity involved in threat assessment and reduction, except the general public and the individuals or entities about whom the data pertains.
To the extent these data are used to adversely affect any lawful interests of any American, due process requires that these data be made available to these individuals and entities for challenge.
America and Americans must not, ever, tolerate a governmental system of secret data used to affect a lawful interest of any individual or entity without these data being made available to the affected individual or entity. Any system to the contrary is by definition a kangaroo system in which no democratic government has any legitimate interest.
