NPR has obtained audio transcripts of the unclassified portions for several Combat Status Review Tribunals (CSRT).

An analysis of CSRT data by Seton Hall University School of Law Professor Mark Denbeaux and students found that every CSRT, from a sample of over 300 CSRTs, resulted in a determination that the detainee was an enemy combatant.

In all sample CSRTs the government presented no witnesses, provided little or no opportunity for a detainee to obtain or present evidence, relied on secret evidence unavailable to the detainee, and overruled all initial decisions by a CSRT that the detainee was not an enemy combatant. In short, confirmed that the CSRT is a kangaroo process.

It is little help to the government that the purpose of a CSRT is not to determine innocence or guilt. These CSRTs are depriving individuals of their life and liberty for indefinite periods of time without charges or tested evidence or a scintilla of due process.

That Americans, Congress or any Court in America would let these CSRTs stand for a nanosecond is an American travesty. Every American must demand that these kangaroo CSRTs be stopped, immediately. They fool nobody and are creating enormous harm with little or no good.¹

1. If a detainee has committed a crime or engaged in acts of war against America then file charges or present the evidence, respectively. In the absence of detainee charges or evidence that a detainee more likely than not engaged in acts of war, each detainee must be immediately released. Do not continue insulting Americans and the world with your kangaroo CSRTs.

And NEVER let us hear you say that the government has “secret evidence” that you cannot show those charged or detained. If the evidence is secret and it must remain secret then DO NOT use it as the basis for charging or detaining any individual, anywhere, or anytime, period!
