Germany has joined Italy in issuing warrants for the CIA spooks. The German warrants are in connection with in the rendition of German citizen Khaled el-Masri.

As an American, it is not comforting to think we have lapsed in our scrupulous adherence to and advocacy for minimal international conventions on human rights.

I hope we can begin to recover from our lapse. First, by responding to the German and Italian arrest warrants and surrendering the spooks named in any properly issued German and Italian warrants. Second, by initiating our own criminal processes against all those who engaged in the CIA's illegal rendition program¹. Third, by initiating impeachment proceedings and criminal process against our president for his authorization of the illegal CIA rendition program.

1. Including the repeal of the recently enacted Military Commission Act of 2006 (aka In Torture We Trust Act of 2006 or America The Torturer Act of 2006). The In Torture We Trust Act of 2006 purports to grant immunity from prosecution to those who engaged in torture under the then secret and illegal CIA rendition program.

It is important to make a distinction between a lawful rendition program whose purpose is enforcement of properly issued international process and the CIA's unlawful rendition program.

It would be proper and legal for Germany or Italy to render our CIA officers to Germany or Italy for the sole purpose of presenting them to German or Italian judicial authorities in satisfaction of properly issued and recognized international arrest warrants.

It would not be proper or legal for Germany or Italy to render our CIA officers to Cuba for the purpose of torture, extracting confessions or indefinite incommunicado detention etc.
