Who Will Stop The Torture Update-16

02/21/07

On February 20, 2007, the majority of a three judge panel1 from United States Court of Appeals for the District of Columbia Circuit denied Guantanamo detainees habeas corpus rights.

Unfortunately, the majority upheld Congress' authority to suspend habeas corpus2 with respect to the Guantanamo detainees.

Hopefully, as with Rasul v. Bush, and Hamdan v. Rumsfeld the United States Supreme Court will reverse this disastrous ruling of United States Court of Appeals for the District of Columbia Circuit.

-----notes-----

1. Judge David B. Sentelle, A. Raymond Randolph in the majority with Judith W. Rogers dissenting.

2. Congress suspended th habeas corpus for Guantanamo detainees in the Military Commission Act 2006 (aka In Torture We Trust Act 2006 or American the Torturer Act of 2006)

The entire In Torture We Trust Act 2006 must be repealed. It was poorly thought out and hastily enacted just before the November 2006 elections.

Senators Spector and Dodd have introduced legislation (S. 185 and S. 576 repealing the habeas corpus section of the America the Torturer Act of 2006.
