Abd al-Hadi al-Iraqi, variously described as high-ranking terrorist network person, leader of extremist groups allied with al-Qaeda, key paramilitary commander, and high value detainee has arrived at Guantanamo after his arrest in Pakistan.1
If Abd is a battlefield combatant2 he must be held in accordance with the laws of war and treated as a prisoner of war. If Abd al-Hadi al-Iraqi is a non-combatant criminal he must be held under the jurisdiction of a United States District Court in accordance with the United States Constitution.
In either event, Guantanamo along with its Kombat Status Reviews and Kangaroo Kommissions must end immediately.

1. UPDATED The NY Times is reporting that Abd al-Hadi al-Iraqi has been held for months at a secret CIA torture center, prior to his transfer to Guantanamo.
UPDATED It is unknown how long Abd al-Hadi al-Iraqi has been in custody or whether he was held at another secret CIA torture center prior to his transfer to Guantanamo or what charge(s) he is being held on.
2. In either the congressionally authorized but undeclared wars of Afghanistan and Iraq. Both of these congressional authorizations must be repealed in their entirety.
